What is an (E) designation?

An (E) designation is the rezoning of a tax lot that was previously used for manufacturing purposes and has been approved by NYC for residential or commercial use. However, before any development occurs, each designated tax lot must be reviewed by NYC Office of Environmental Remediation (OER) to evaluate the presence of potential hazardous materials contamination, window/wall noise attenuation, and/or air quality impacts. An (E) designation is not a notice of a building violation.

How does an (E) designation affect my property?

An (E) Designation does not affect your property in any way unless you are planning new construction, change in land use, or making alterations to an existing structure; otherwise, you may continue to use your property as you were. If you are planning any new developments the environmental requirements of the (E) designation must be satisfied before you can obtain a building permit from New York City Department of Buildings (DOB).

Who placed the (E) designation on my property?
An (E) designation was placed on your property by the Department of City Planning (DCP) and City Council.

Why was an (E) designation placed on my property?

When a site is rezoned and an environmental investigation shows that development on that site may be affected by hazardous material contamination, window/wall noise attenuation, and/or air quality impacts then an (E) designation may be placed on the site by DCP.
An (E) designation can occur because the property:

  • Was used as or is in close proximity to a gas station or some other underground fuel oil tank;
  • Is located in or contiguous to a manufacturing district; has a history of manufacturing uses;
  • Is located next to a building with a history of manufacturing uses;
  • Is located on a heavily trafficked street or highway; Is located next to a railroad;
  • Has some other environmental condition on the property or nearby that is a cause for concern.

I just found out that an (E) designation was placed on my property, what should I do?
